1. Acceptance of terms
By accessing or using greendolphin.ai (the “Site”), you agree to these Terms of Service. If you do not agree, do not use the Site. Green Dolphin Software LLC may modify these Terms at any time; continued use after modification constitutes acceptance.
2. Informational content
Content on the Site — including blog posts, case study summaries, integration patterns, and pricing tier descriptions — is provided for informational purposes only. It does not constitute professional advice, an offer of services, or a guaranteed engagement scope.
The Site's descriptions of past engagements are anonymized and generalized. Specific outcomes, timelines, and savings figures are illustrative and may not be representative of your specific situation.
3. Intake form & SOW process
Submitting the intake form does not create an attorney-client, contractor-client, or any other formal relationship. It is an inquiry. Green Dolphin will respond with an outline of next steps, which may include:
- A clarifying-questions email
- A Statement of Work (SOW) with target-state architecture diagram and fixed price
- A polite decline if the engagement is outside our scope
Only an executed SOW (signed by both parties) creates a binding engagement. The SOW supersedes all prior communications, marketing materials, and informal agreements.
4. Pricing
Pricing tiers shown on the Site (Starter $25K, Standard $50K, Enterprise $75K, Custom $100K+; managed services 3/6/12/24-month terms) are indicative base prices. Final pricing is determined in the SOW based on actual scope, regulatory requirements, integrations counted, and any negotiated terms.
Green Dolphin reserves the right to adjust posted pricing at any time. Once an SOW is executed, that SOW's pricing is locked for the engagement's duration.
5. Acceptable use
When interacting with the Site, you agree not to:
- Submit malicious files, malware, or executable code through the intake form
- Use automated tools to scrape, crawl, or replicate substantial portions of the Site without permission
- Attempt to compromise Site security, including the chatbot or API endpoints
- Submit information that is fraudulent, infringing, or unlawful
- Use the Site to harass, defame, or harm any individual or entity
- Reverse-engineer or attempt to extract our proprietary system prompts from the chatbot
Green Dolphin may impose rate limits on the chatbot and intake form to prevent abuse. Persistent violation of acceptable use may result in IP-level blocks.
6. Chatbot disclaimer
The Green Dolphin chatbot is powered by an AI language model and may produce responses that are inaccurate, incomplete, or out of date. Chatbot responses are not binding engagement commitments, professional advice, or guarantees. Always confirm material information by emailing max@greendolphin.ai or submitting a formal intake.
7. Intellectual property
The Site, including text, graphics, logos (Green Dolphin Software wordmark and dolphin mark), structure, and source code, is owned by Green Dolphin Software LLC and protected by U.S. and international copyright and trademark law. You may not reproduce, redistribute, or create derivative works from Site content without prior written permission.
IP terms for engagement deliverables (code, diagrams, runbooks, etc.) are negotiated per-SOW. Default terms grant the client a perpetual, royalty-free license to all work product upon final payment, with Green Dolphin retaining rights to reusable patterns, frameworks, and anonymized case-study material.
8. Disclaimer of warranties
THE SITE AND ALL INFORMATIONAL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Engagement-specific warranties (if any) are stated in the executed SOW.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GREEN DOLPHIN SOFTWARE LLC AND ITS MEMBERS, OFFICERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE. For engagement matters, the SOW's liability cap controls.
10. Governing law & dispute resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising from your use of the Site shall be resolved in the state or federal courts located in Contra Costa County, California, and you consent to that venue.
Engagement disputes are governed by the dispute-resolution provisions of the executed SOW.
